Patna High Court

Rambachchan SharmaversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The Court held that there were no fresh grounds to grant bail and therefore denied the bail application.

Summary

The petitioner, Rambachchan Sharma, was charged under Section 87 of the Bihar Narcotic Substances (BNS) Act and Sections 8 and 12 of the Protection of Children from Sexual Offences (POCSO) Act for allegedly abducting a minor girl with the intention of marrying her. The petitioner pleaded innocence, claiming he has no prior criminal record and that the allegations are false. He had previously applied for regular bail, which was rejected by the Patna High Court on 2 July 2025. On a fresh bail application, the Court found no new material or fresh ground to revisit the earlier decision and therefore again denied bail. The Court directed the trial court to complete the trial within three months of receiving a copy of the order.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences under the BNS Act and POCSO Act.
  • Whether any fresh ground or material has arisen to warrant a reconsideration of the earlier bail denial.
