Patna High Court

Rupa Devi @ Rupa KumariversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The petition for anticipatory bail was rejected.

Summary

The petitioner, Rupa Devi, sought anticipatory bail after being implicated in a FIR alleging that she, along with co‑accused, doused the deceased (the informant’s daughter) with petrol and set her on fire, resulting in death. The FIR charges pertain to offences under Sections 103(1) and 3(5) of the B.N.S., 2023. The petitioner contended she had no involvement, maintained a clean antecedent, and was merely the elder sister‑in‑law of the deceased. The State opposed the bail, asserting that the petitioner was the one who actually poured petrol and ignited the fire, and highlighted the gravity of the alleged homicide. The Court, after hearing both sides, rejected the petition for anticipatory bail, finding the nature of the accusation serious enough to deny relief. Consequently, the bail application was dismissed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances alleged in the FIR
  • Whether the allegations under Sections 103(1) and 3(5) of the B.N.S., 2023, justify denial of anticipatory bail

opposes the prayer for bail and submits that it was this

(informant’s daughter) and ignited fire. Moreover, the deceased

for anticipatory bail of petitioner is rejected.
