BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner.

Summary

Mahesh Kumar, the owner of a motorcycle from which 43.20 litres of liquor was seized, was charged under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act. He applied for bail, contending that he was falsely implicated, had no knowledge of the contraband, and that no incriminating article was found in his possession. The petitioner also highlighted the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, and noted his prior criminal antecedent. The State opposed the bail application. Considering the circumstances, including the period of custody and the petitioner's claim of non‑possession, the Court granted bail on the condition of a Rs.15,000 bond with two sureties. The order released the petitioner from custody pending further trial.

Issues considered

  • Whether bail should be granted to the accused under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act.
