Patna High Court

RATAN KUMAR @ KARAN @ KARAN KUMARversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court held that bail could not be granted as the nature of the accusations and the recovered weapon warranted continued detention.

Summary

The petitioner, Ratan Kumar, applied for regular bail in a case registered under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act, alleging that he was implicated in the murder of a political rival’s husband. The FIR named other accused, but the petitioner’s name emerged during investigation and he has been in custody since 12 August 2025. The State opposed bail, highlighting that the pistol and cartridge used in the alleged crime were recovered from the petitioner’s country. The Court, after considering the seriousness of the offences and the material evidence, rejected the bail application. However, the Court directed the trial court to expedite the trial and conclude it within one year of receiving this order.

Issues considered

  • Whether regular bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita and the Arms Act in view of the nature of the offences and the recovery of the weapon.
  • Whether the petitioner’s custody since 12 August 2025 warrants a speedy trial.
