Holding

Bail was denied to the petitioner.

Summary

The petitioner, Indal Paswan, applied for bail in a criminal miscellaneous case arising from a 2022 dacoity case (PS No. 48) in Babubarhi, Madhubani. He is charged under Sections 395 and 397 of the Indian Penal Code, Section 27 of the Arms Act and Section ¾ of the Explosive Substances Act, and has been in custody since 10 March 2025. The prosecution alleges that he participated in a dacoity at the informant's house and that he is implicated in twelve other serious cases, with his name appearing in a co‑accused’s self‑inculpatory statement and material evidence recovered from the co‑accused’s house. The court considered the seriousness of the offences, the existence of multiple pending cases, and the incriminating statements, and concluded that granting bail would be inappropriate. Consequently, the bail application was dismissed.
