Vilash YadavversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court held that, in view of the petitioners’ lack of involvement in the alleged offences, anticipatory bail may be granted under Section 482 of the B.N.S.S., 2023 subject to conditions.

Summary

The petitioners, Shanti Devi, Shukhendra Yadav and Ravita Devi, sought anticipatory bail fearing arrest in a case registered under Sections 126(2), 115(2), 103(1) and 3(5) of the B.N.S. relating to the alleged dowry‑related murder of a daughter-in‑law. The prosecution alleged that the deceased was killed by her in‑laws, while the petitioners, being mother‑in‑law, brother‑in‑law and sister‑in‑law, claimed no involvement in the crime. The State opposed the bail. The court examined whether the petitioners had any material connection to the alleged offences and whether Section 482 of the B.N.S.S., 2023 permitted anticipatory bail. Finding no direct participation, the court ordered that the petitioners be released on anticipatory bail upon furnishing a bail‑bond of Rs.10,000 with two sureties each, within eight weeks of arrest, subject to the usual conditions. The bail application was disposed of accordingly.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 482 of the B.N.S.S., 2023.
  • Whether the petitioners have any material involvement in the offences alleged under Sections 126(2), 115(2), 103(1) and 3(5) of the B.N.S.
