Patna High Court

Buchari Mandal @ Buchhar MandalversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Regular bail is denied to the petitioner.

Summary

The petitioner, Buchari Mandal, applied for regular bail in a case registered under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. He was not named in the FIR; his alleged involvement emerged from a confessional statement of co‑accused Ranjit Mandal. The petitioner has been in custody since 10 October 2025 and the State opposed bail, highlighting three prior criminal convictions. The court examined the seriousness of the offences, the gravity of the allegations, and the petitioner’s antecedents, and concluded that bail could not be granted. Consequently, the bail application was rejected, and the trial court was directed to complete the trial within one year of receiving the order.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the seriousness of the offences and his criminal antecedents
  • Whether the petitioner’s implication through a co‑accused’s confessional statement suffices for bail denial

                                       ORAL ORDER

2 16-02-2026 Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. Petitioner seeks regular bail in connection with

Bihpur P. S. Case No. 161 of 2025 registered for the offences

punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya

Sanhita and Section 27 of the Arms Act.

                                3. The informant suspects that because of land

dispute, which is going on between the parties for the last

several years, all the F.I.R. named accused persons killed her

                   husband.

                                4. Learned counsel for the petitioner submits that

petitioner is not named in the F.I.R. and his name transpired

during investigation in confessional statement of co-accused

Ranjit Mandal. Petitioner is in custody since 10.10.2025.
Patna High Court CR. MISC. No.7958 of 2026(2) dt.16-02-2026
                                                          2/2

                                     5. Learned A.P.P. for the State vehemently opposed

the bail application and submitted that petitioner has got three

                        criminal antecedents.

                                     6. Considering the nature of accusation, gravity of the

offence and criminal antecedents, prayer for regular bail of the

                        petitioner is rejected.

                                     7. However, since petitioner is in custody since

10.10.2025, Trial Court is directed to expedite and conclude the

trial, preferably, within a period of one year from the date of

receipt/production of copy of this order.
