Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to a bail bond and conditions.

Summary

Anil Ram was arrested in connection with a case registered under Section 75(2) of the BNS and Sections 8 and 12 of the Protection of Children from Sexual Offences (POCSO) Act, alleging that he touched a 14‑year‑old girl. The petitioner sought regular bail, claiming a clean antecedent and that the complainant had compromised the case. The State opposed bail, citing the seriousness of the offences. The court considered the nature of the allegations, the petitioner’s background, and the need for his cooperation in trial. It ordered the petitioner to furnish a bail bond of Rs.10,000 with two sureties and directed his release, subject to conditions of cooperation and availability for trial. The bail was granted and the petitioner was released on the stipulated terms.

Issues considered

  • Whether regular bail can be granted to an accused charged under Section 75(2) of the BNS and Sections 8 and 12 of the POCSO Act
  • Whether the petitioner’s clean antecedents and alleged compromise by the complainant justify bail
