Patna High Court

Ramlakhan ChoudharyversusThe State of Bihar

Decided

DISPOSED

Holding

The Court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s antecedents.

Summary

The petitioner, Ramlakhan Choudhary, sought anticipatory bail fearing arrest in a case registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 for alleged recovery of 153 litres of liquor from a public bush near an embankment. He contended that the liquor was not in his possession, the location did not belong to him, and the allegation was based solely on secret information without a proper investigation, emphasizing his clean criminal antecedent. The State opposed the grant of anticipatory bail. The Court, after considering the submissions, ordered provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and directed the trial court to verify the petitioner’s antecedents. It further stipulated that if any antecedent is discovered, the provisional bail would not be confirmed; otherwise, it would be confirmed forthwith. The order was made under the inherent powers of the Court under Section 482(2) of the Code of Criminal Procedure.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018
  • Whether the allegations based on secret information and lack of possession justify denial of bail
  • Whether the petitioner’s clean antecedent warrants provisional bail pending verification

2 17-01-2026 1. Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

recovery of 153 litres of liquor from a bush near side of an

embankment. It is next submitted that petitioner was not

arrested from the spot as such nothing was recovered from his

conscious possession and even alleged recovery is from a place

which does not belong to the petitioner and is accessible to

public at large and he came to be implicated based on secret

without holding a proper investigation, when petitioner

admittedly is a person with clean antecedent.

                       4. Learned A.P.P. for the State opposes the prayer for

counsel for the petitioner, the petitioner above-named, in the

under Section 482(2) of the B.N.S.S.

                       6. It is made clear that the learned trial court thereafter

shall verify the criminal antecedents of the petitioner and in the

event if it is found that petitioner has antecedent of even one

case, in that event, it would be presumed that petitioner had

concealed his antecedent before this court, as such, the

provisional anticipatory bail order shall not be confirmed but if

on verification it is found that petitioner is a person with clean
