Patna High Court

Munni Rai @ Munna KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to a bail bond, sureties and the conditions prescribed under Section 482 of the B.N.S.S., 2023.

Summary

The petitioner, Munni Rai (also known as Munna Kumar), sought anticipatory bail fearing arrest in a case registered under Sections 80 and 3(5) of the B.N.S. The prosecution alleged that the informant’s daughter, married to co‑accused Neeraj Kumar, was subjected to dowry‑related cruelty and was murdered on 26‑07‑2024. The petitioner contended he had no familial or substantive connection with the deceased or her in‑laws, being merely a co‑villager of the husband, who is already in custody. The State opposed the bail application. The Court, after considering the facts, ordered that the petitioner be released on anticipatory bail within eight weeks, upon furnishing a bail bond of Rs 10,000 with two sureties, subject to the conditions of Section 482 of the B.N.S.S., 2023.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482 of the B.N.S.S., 2023 despite the allegations under Sections 80 and 3(5) of the B.N.S.
  • Whether the petitioner’s alleged lack of connection to the victim and the primary accused justifies the grant of bail.
