Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied to the petitioner.

Summary

The petitioner, Rasula Begum, was implicated in a case (PS Case No. 427 of 2025) for allegedly assembling with about 20 persons near Laheriyasarai Police Station to release a detainee, Md. Rabbani, and for obstructing police by blocking the road and pelting stones. The FIR lists numerous offences under the Bharatiya Nyaya Sanhita, including sections 191(2), 191(3), 190, 126(2), 115(2), 132, 109, 121(2), 285, 293, 112(2), 125, 313, 265, and 61(2). The petitioner, who has three prior criminal convictions, applied for anticipatory bail fearing arrest. The Court examined the seriousness of the alleged offences, the petitioner’s criminal antecedents, and the potential for tampering with evidence or influencing witnesses. Considering the nature of the accusations and the petitioner’s history, the Court refused the anticipatory bail application. Consequently, the petition for anticipatory bail was dismissed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the Bharatiya Nyaya Sanhita given the nature of the alleged offences
  • Whether the petitioner’s prior criminal antecedents justify denial of anticipatory bail
