Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to the conditions stipulated under Section 438(2) CrPC and Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

The petitioner, Faiyaz Quraishi, sought anticipatory bail fearing arrest in a case involving offences under Sections 147, 149, 341, 342, 323, 353, 435 and 308 of the Indian Penal Code, alleged to have arisen from a protest on NH‑1 and a vehicle arson. The prosecution’s case is based largely on CCTV footage linking the petitioner to the incident, while the petitioner contends he is innocent, has no specific allegation of an overt act against him, and has a clean antecedent. The learned counsel highlighted that similarly situated co‑accused had already been granted anticipatory bail. The State opposed the relief. After considering the material, the Court granted anticipatory bail on the condition of a bail bond of Rs.10,000 with two sureties, subject to Section 438(2) of the Code of Criminal Procedure and Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 CrPC.
  • Whether the material on record, primarily CCTV footage, suffices to deny anticipatory bail.
  • Whether Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023, is applicable to the grant of anticipatory bail.
