The court granted bail to the petitioner, directing him to furnish a bail bond of Rs 10,000 with two sureties.

Summary

Vikram Kumar was arrested in connection with a cyber‑crime case (Cyber P.S. Case No. 21 of 2025) alleging offences under several sections of the B.N.S., 2023 and the Information Technology Act, including fraud, threats and illegal access. The prosecution alleged that the accused were operating from a call‑center‑like premises, editing photographs and threatening borrowers for loan recovery. The petitioner pleaded innocence, contending that the recovered devices showed only that loans were paid through fake sites and that he had no criminal antecedent, and highlighted that co‑accused had been granted bail in similar matters. The petitioner’s counsel also pointed out that he had been in judicial custody since 16 April 2025. After hearing both sides, the court found no sufficient ground to deny bail and ordered the petitioner’s release on a bail bond of Rs 10,000 with two sureties. The order directs compliance with the Judicial Magistrate, 1st Class, Sitamarhi.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the cyber‑offences alleged under the B.N.S., 2023 and the IT Act.
  • Whether the petitioner poses a flight risk, threat to public order, or likelihood of tampering with evidence warranting denial of bail.
