BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner.

Summary

Rahul Kumar sought anticipatory bail after the police, relying on secret information and local testimony, implicated him in a case under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022, for allegedly storing illicit liquor. The FIR alleged that liquor was recovered from a field and an empty shop, neither of which belonged to the petitioner. The petitioner argued that the recovery was not from his premises and that the basis of the accusation was tenuous. The court examined the facts and noted that the liquor was seized from open and public spaces, not the petitioner’s property. Consequently, the court granted anticipatory bail, subject to a bond of Rs.10,000 and two sureties, under Section 482(2) of the B.N.S.S. 2023.

Issues considered

  • Whether anticipatory bail can be granted when the alleged contravention is based solely on secret information and recovery of liquor from premises not owned by the petitioner
