Patna High Court

Sikandar Kumar @ Sikendar KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner in view of the facts and circumstances of the case.

Summary

Sikandar Kumar was arrested in connection with a case registered under Sections 126, 115(2), 76, 324(4), 324(5), 3(5), 109 and 117(2) of the B.N.S., 2023 for allegedly assaulting a victim and causing injury. The petitioner pleaded innocence, asserted that he has no prior criminal record and has been in custody since 8 December 2025. The State opposed the bail application, arguing that the offences are serious. The Court examined the facts, the nature of the offences and the petitioner’s personal circumstances. Considering the lack of antecedents and the circumstances of the case, the Court allowed the bail application. The petitioner was ordered to be released on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the petitioner for the offences alleged under the B.N.S., 2023.
  • Whether the nature of the offences and the petitioner’s personal circumstances justify the grant of regular bail.
