Pappu KumarversusThe State of Bihar

Provisional anticipatory bail is granted to the petitioner, subject to bond, sureties, and verification of antecedents.

Summary

The petitioner, Pappu Kumar, was implicated in a case alleging recovery of 160 litres of liquor from two motorcycles, one of which he owned. He argued that he had no knowledge of the liquor being in his vehicle and that no liquor was found in his immediate possession, emphasizing his clean criminal record. The State opposed his request for anticipatory bail. The Court, considering the lack of direct possession, the petitioner's clean antecedent, and the principle that an owner need not be complicit for a friend's misuse of the vehicle, granted provisional anticipatory bail subject to a modest bond and two sureties. The order also directed the trial court to verify the petitioner's antecedents, with the bail to be confirmed only if no prior cases are found.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail despite the alleged recovery of liquor from a vehicle he owned.
  • Whether the lack of direct possession and a clean antecedent justify granting anticipatory bail.

                   A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

came to be implicated based on the fact that he is owner of one

of the seized vehicle. It is next submitted that no prudent person

implicated. It is thus submitted that the petitioner was

completely unaware that his friend would misuse his vehicle in

          the manner as alleged.

                       4. Learned A.P.P. for the State opposes the prayer for

counsel for the petitioner, the petitioner above-named, in the

event of his arrest or surrender before the learned Court below

within a period of six weeks from today, be released on

provisional anticipatory bail on furnishing bail bonds of

                       6. It is made clear that the learned trial court thereafter
