BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners, subject to conditions, under Section 482(2) of the CrPC.

Summary

The petitioners, seven young men from Karneji village, were named in FIR No. 180 of 2025 for alleged assault and robbery against an informant and his family, involving weapons such as an iron rod, a sharp cutting instrument and a bamboo stick, and the theft of a gold chain and Rs.18,000. They claimed innocence, arguing that the case stemmed from a land dispute and that the injuries were simple, with only one of them having a prior criminal record. The State and the informant opposed anticipatory bail, while the petitioners sought relief to avoid arrest. The Court examined the FIR, noting the lack of specific details about the weapon used and the minor nature of the injuries, and considered the motive of the dispute. Balancing the allegations against the petitioners' right to liberty, the Court granted anticipatory bail subject to conditions under Section 482(2) of the CrPC. The order directed the petitioners to furnish bail bonds of Rs.10,000 each with two sureties upon arrest or surrender within six weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the CrPC in view of the allegations in FIR No. 180 of 2025.
  • Whether the nature of the alleged offences and the evidence disclosed warrant denial of bail.

the learned Additional Sessions Judge-III, Vaishali at Hajipur

dated 20.08.2025, it appears that on the basis of written report of

the informant, namely, Mantosh Kumar, FIR has been registered

          under Sections 191(2), 126(2), 329(3), 109(1), 303(2), 115(2),

and no other description has been mentioned in the impugned
