Patna High Court

Kanhaiya BinversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner, subject to monetary bond and strict conditions.

Summary

The petitioner, Kanhaiya, was arrested in a dowry‑death case (Sections 80 and 238 of the Bharatiya Nyaya Sanhita, 2023) alleging that he and family members tortured and killed the deceased for dowry demands and concealed the body. He contended that he was falsely implicated, being a fisherman with no connection to the deceased’s husband, and that no specific overt act was alleged against him. The State opposed bail, while the petitioner highlighted the husband’s custody, his own lack of criminal antecedent, and the general nature of the allegations. The Court, noting the husband’s custody and the petitioner’s prolonged detention, decided to grant bail subject to a bond of Rs. 15,000 with two sureties and conditions regarding appearance, non‑tampering with evidence, and non‑intimidation of witnesses. The bail order was issued pending framing of charges, if not already done.

Issues considered

  • Whether bail should be granted to the accused in a dowry‑death case under Sections 80 and 238 of the Bharatiya Nyaya Sanhita, 2023.
  • Whether the petitioner is likely to tamper with evidence or influence witnesses.
  • Whether the petitioner poses a flight risk or has sufficient grounds for continued detention.
