Patna High Court

Pritam RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner upon furnishing a bond of Rs.10,000 and two sureties.

Summary

The petitioner, Pritam Ram, applied for bail in a criminal case registered under Sections 103(1), 80 and 3(5) of the B.N.S., 2023, alleging that he is innocent of the charges. He is the husband of a woman who died from burn injuries while cooking, and he contends that the death was accidental and not a result of any criminal act. The State opposed the bail, but the court considered the petitioner’s clean antecedents, the circumstances of the death, and the period of custody since his arrest on 19‑08‑2025. The court found no substantive evidence linking him to the alleged offence. Consequently, the court ordered his release on bail upon furnishing a bail bond of Rs.10,000 with two sureties of equal amount, subject to the satisfaction of the Additional Chief Judicial Magistrate, Kaimur.

Issues considered

  • Whether bail should be granted to the petitioner in the case registered under Sections 103(1), 80 and 3(5) of the B.N.S., 2023
  • Whether the circumstances of the deceased’s death and the petitioner’s antecedents justify bail
