The court granted anticipatory bail to the petitioner subject to specified conditions.
Summary
Paspati Devi, a 74‑year‑old woman with a clean record, sought anticipatory bail after being implicated in a case registered under Sections 80 and 3(5) of the Bihar Narcotic Substances Act, 2023, relating to alleged dowry‑related torture and murder. The petitioner argued that the informant was not an eyewitness, that the allegations were based on suspicion and omnibus claims, and that the dead body was found lying in the house, with post‑mortem indicating death by hanging. The State opposed the bail, contending the seriousness of the offences. The court, after considering the submissions, granted anticipatory bail on the condition that the petitioner surrender within six weeks, furnish bail bonds of Rs.10,000 with two sureties, and cooperate with the investigation. The order also empowered the trial court to cancel the bail if the petitioner fails to cooperate.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Sections 80 and 3(5) of the Bihar Narcotic Substances Act, 2023.
- Whether the petitioner’s alleged involvement is sufficiently substantiated to deny bail.
