Patna High Court

Akash Yadav @ Akash KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court dismissed the anticipatory bail petitions, holding that the nature of the offences and the evidence against the petitioners did not merit the grant of anticipatory bail.

Summary

The petitioners, who were named in an FIR for assaulting and fatally shooting the informant’s brother at a bridge construction site, filed anticipatory bail petitions fearing arrest under Sections 115(2), 126(2), 308(5), 103(1) of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. The FIR alleged that the accused brutally attacked the victim with an iron rod and wooden log and later fired bullets into his limbs, causing his death. Numerous witnesses corroborated the prosecution’s case and identified the petitioners. The High Court examined whether the seriousness of the offences and the likelihood of the petitioners evading investigation justified granting anticipatory bail. Concluding that the nature of the accusations warranted custody and that the petitioners were not entitled to pre‑emptive release, the Court dismissed all three anticipatory bail petitions.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under the offences charged under Sections 115(2), 126(2), 308(5), 103(1) of the B.N.S., 2023 and Section 27 of the Arms Act.
  • Whether the seriousness of the alleged assault and homicide precludes the grant of anticipatory bail.
