Patna High Court

Ranjit YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond and sureties, under the conditions of Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Ranjit Yadav, was named among 21 accused in an FIR for indiscriminate firing that injured a child and a woman. He faces charges under Sections 191(2), 191(3), 190, 111(2), 109 of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. The petitioner contended that the allegations against him were vague, general and omnibus, with no specific overt act attributed to him, and asserted a clean antecedent. The State opposed his bail application. The Court, considering the lack of specific allegations, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether a bail order can be granted when the allegations against the accused are general and omnibus without specific overt acts.
  • Whether the charges under the Bharatiya Nyaya Sanhita and Arms Act justify denial of bail.
  • Applicability of Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in granting bail.
