WITHDRAWN

Holding

The court permitted the withdrawal of the anticipatory bail applications and dismissed them as withdrawn.

Summary

The petitioners, comprising three separate police officers, filed anticipatory bail applications in connection with a complaint case (PS Case No.336/2024). While these applications were pending, the trial court quashed the underlying complaint on 18-02-2026 in Criminal Miscellaneous No.47802 of 2025 (Haribansh Mahto & Ors. vs. State of Bihar). The petitioners then moved the Patna High Court seeking permission to withdraw their anticipatory bail applications, arguing that the quashing rendered the bail unnecessary. The learned counsel for the State opposed the withdrawal. Justice Satyavrat Verma allowed the withdrawal, holding that the petitioners were entitled to retract their applications after the complaint was dismissed, and consequently ordered the anticipatory bail applications to be dismissed as withdrawn.

Issues considered

  • Whether the petitioners may be permitted to withdraw pending anticipatory bail applications after the underlying complaint has been quashed
  • Effect of the quashing of a complaint on the continuance of anticipatory bail proceedings
