Patna High Court

Niraj Kumar @ Niraj Kumar MahtoversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court inclined to grant bail to the petitioner, subject to monetary bond and strict conditions.

Summary

The petitioner, Niraj Kumar, was arrested in connection with a case involving alleged theft of three motorcycles and charged under Sections 317(2), 317(5), 338, 336(3) and 340(2) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that the motorcycles were recovered without proper documentation, while the petitioner claimed he was falsely implicated, possessed valid documents for the vehicles, and had no involvement in the theft. He had been in custody since 13 August 2025 and had three prior criminal antecedents, and the State argued that Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023 had not been complied with. The court, after considering the circumstances and the period of detention, decided to grant bail subject to a bond of Rs.15,000 with two sureties and specific conditions regarding appearance, non‑tampering with evidence and non‑intimidation of witnesses. The bail order was conditioned on the petitioner’s compliance with these terms, and the trial court was directed to cancel bail if any condition was violated.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences and his prior criminal record.
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, warrants denial of bail.
