Patna High Court

Sahendra Yadav @ SahendraversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to both petitioners, directing them to furnish a bail bond of Rs.10,000 with two sureties each.

Summary

The petitioners, Sahendra Yadav and Ravikant, were charged under sections 121(1), 121(2), 109, 132 and 3(5) of the Bhartiya Nyaya Sanhita, 2023 and section 27 of the Arms Act for allegedly attempting to escape in a vehicle, firing at police and then fleeing. The prosecution’s FIR alleged that the accused fired on police personnel but no person was injured. The petitioners contended that they were falsely implicated, that no injury occurred, and that they had been in custody since 25 May 2025 with the charge‑sheet already filed. The State opposed the bail application. The Court, noting the absence of any injury, the prolonged pre‑trial detention of over eight months, and the filing of the charge‑sheet, ordered that both petitioners be released on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties each.

Issues considered

  • Whether regular bail should be granted to the accused despite the seriousness of the offences under the Bhartiya Nyaya Sanhita and the Arms Act
  • Whether the prolonged pre‑trial detention and the filing of the charge‑sheet justify bail
