BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner under Section 482 of the B.N.S.S.

Summary

Manoj Kumar Singh sought anticipatory bail fearing arrest in a case (Aayar P.S. Case No. 83 of 2025) that alleged offences under several sections of the B.N.S. The prosecution’s informant claimed that Singh’s household members assaulted him with iron rods and sticks after a dispute over a complaint by a village woman. Singh contended that the allegations were fabricated due to village politics and that the injuries reported were minor. The State opposed the bail, but the court, noting the possibility of false accusation and the simple nature of the injuries, decided to grant anticipatory bail. The order directed that Singh be released on bail if arrested or surrendered within four weeks, subject to a Rs 10,000 bond, two sureties, and the condition that one bailor be a close relative. The bail was granted under Section 482 of the B.N.S.S. with standard conditions.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in view of the alleged false accusations and political motive.
  • Whether the nature of the alleged offences and the evidence presented justify denial of bail.

3 11-02-2026 Heard learned counsel for the petitioner and learned

                   APP for the State.

                                2. The petitioner is apprehending his arrest in

connection with Aayar P.S. Case No. 83 of 2025 for the offence

                   under Sections 126(2), 115(2), 190, 191(2), 351(2), 109 and

                   303(2) of the BNS.

                                3. As per the prosecution story, the informant has

alleged that on 12.08.2025 at about 7:00 PM, a woman from the

village complained that someone from his house had beaten her

minor son. The informant replied that the matter was serious and

assured that he would look into it and stop such conduct if found

true. Meanwhile, accused Madan Singh began abusing the

informant in filthy language. When the informant protested

against such abuse, all the F.I.R. named accused persons, armed

with iron rods and sticks assaulted the informant on his head

causing a deep head injury and profuse bleeding. Accused

Nandan Singh lifted the informant and threw him to the ground.

Vinod Singh and Nirmal Singh further assaulted the informant

          with sticks, causing multiple injuries.

                       4. Learned counsel for the petitioner submits that the

petitioner has falsely been made an accused in the present case

by the informant due to dirty village politics and ulterior motive

with due deliberation, fabrication and much consultation. The

petitioner and informant are resident of same village and no

such occurrence has occurred as alleged in the F.I.R. There is

case and counter case between both the parties and as per F.I.R.,

three persons have assaulted the informant however the injury

report of injured persons reflects that all the injuries sustained

by him are simple in nature

                       5. Learned APP opposes the prayer for bail.

                       6. Keeping in view the aforesaid facts, this Court is

inclined to extend him the privilege of anticipatory bail.

                       7. Let the petitioner be released on bail in the event of

arrest or surrender within a period of four weeks from the date

of receipt of this order, on furnishing bail bond of Rs. 10,000/-
