Anticipatory bail is granted to petitioner No.2 but denied to petitioner No.1.

Summary

Manoj Kumar Singh and Bablu Singh sought anticipatory bail after an FIR alleged they were involved in illegal sand mining from the Batane river, resulting in the seizure of 1,000 cubic feet of sand. The petitioners claimed innocence, noting that petitioner No.1 was not named in the FIR and that petitioner No.2 had only a prior unrelated criminal case. The State opposed bail, highlighting that petitioner No.1 had two prior similar offences. The court examined the nature of the allegations and the criminal antecedents of each petitioner. It denied pre‑arrest bail to petitioner No.1 but granted anticipatory bail to petitioner No.2 subject to a bail bond of Rs.10,000 and two sureties, with conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to petitioner No.1 in view of his prior similar offences.
  • Whether anticipatory bail should be granted to petitioner No.2 despite a prior unrelated criminal case.
