Patna High Court

Furkan @ Md FurkanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Furkan, was arrested in connection with a kidnapping case (PS Amour Case No. 295 of 2025) alleged under Sections 137(2), 87 and 3(5) of the Bhartiya Nyaya Sanhita, 2023. The prosecution alleged that he, along with co‑accused, abducted the minor daughter of an informant on a motorcycle. The petitioner’s counsel argued that no witness corroborated the charge and that the victim’s statement under Section 183 BNSS did not accuse him of any assault or misconduct, and that the victim even identified him as innocent. The victim, examined as PW‑1, claimed the petitioner did nothing wrong and is about 18 years old. The court, noting the lack of incriminating evidence, the victim’s testimony, and the petitioner’s clean record, ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties.
