Holding
The Court held that bail must be granted to the petitioners.
Summary
The petitioners, Akhilesh Singh and Md. Sikandar, were arrested on 5 December 2025 in connection with a case alleging possession of 58 litres of liquor recovered from a plastic sack, under Section 30(a) of the Bihar Prohibition and Excise Act. They claimed innocence, arguing that the sack did not belong to them, no incriminating material was found on them, and they had no prior criminal record. Their counsel contended that the arrest was based solely on suspicion and that the prosecution failed to comply with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail. Considering the lack of substantive evidence, the length of custody, and the statutory non‑compliance, the Court granted bail, ordering each petitioner to furnish a bail bond of Rs. 15,000 with two sureties of equal amount.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the circumstances of arrest.
- Whether the prosecution complied with the procedural requirements of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
