Patna High Court

Vinod Ram @ Binod KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to the conditions specified under Section 482(2) of the B.N.S.S.

Summary

The petitioners, Vinod Ram, Rahul Kumar and Subhas Ram, applied for anticipatory bail fearing arrest in a case registered under multiple sections of the Bihar Negotiable Substances Act, 2023. They contended that they have clean antecedents and were falsely implicated by an informant who alleged a disturbance at a marriage ceremony involving vulgar songs, leading to alleged assaults and theft. The petitioners highlighted a four‑day delay between the alleged incident on 05‑06‑2025 and the filing of the FIR on 09‑06‑2025, arguing that the FIR lacks specific allegations against them. The State opposed the bail. The Court, after considering the submissions, ordered that the petitioners be released on anticipatory bail if arrested or surrendered within six weeks, upon furnishing a bail bond of Rs 10,000 each with two sureties, subject to the conditions of Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the B.N.S.S.
  • Whether the FIR and the alleged offences constitute sufficient ground for arrest of the petitioners
  • Whether the delay in filing the FIR and the claim of false implication affect the grant of bail

                   APP for the State.

                                2. Petitioners apprehend their arrest in a case

registered for the offences punishable under Sections 191(2),

                                3. Learned counsel for the petitioners submits that

petitioners are persons with clean antecedent and the informant

alleges that the accused persons were playing vulgar songs in a

marriage, as such, the informant objected, leading to an

altercation and Santosh dashed the informant on the ground and
