The Court granted bail to the petitioner subject to bond and surety conditions.
Summary
The petitioner, Pawan Kumar Yadav, was arrested in connection with the seizure of 405 litres of liquor from a Scorpio vehicle, alleged under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was merely the driver, not the owner, and had no knowledge of the contraband, asserting false implication and lack of any incriminating article in his possession. The State opposed bail, while the petitioner highlighted his clean record, custody since 10‑01‑2026, and the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The Court, after considering the circumstances and duration of custody, decided to grant bail. Bail was conditioned on a bond of Rs.15,000 with two sureties, one being a close family member, and the requirement that the petitioner appear at every trial date, with cancellation possible upon two consecutive defaults.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, warrants denial of bail.
- Whether the petitioner’s role as driver without ownership or knowledge of the seized liquor absolves him from pre‑trial detention.
