The court granted bail to the petitioners subject to the stipulated bond and surety conditions.
Summary
The petitioners, Ranjan Singh and Rohit Singh, sought bail fearing arrest in a criminal case (Warisnagar P.S. Case No. 199 of 2025) filed under multiple sections of the Bharatiya Nyaya Sanhita, including offences relating to attempted murder, assault, and weapon use. They were alleged to have fired a weapon that missed the informant and subsequently assaulted the informant, though no injury report was recorded. A counter‑case and a prior compromise petition between the parties were also noted. The High Court, after hearing counsel, allowed the bail application, directing that if the petitioners are arrested or surrender within six weeks, they be released on bail with a bond of Rs 10,000 each and two sureties of the same amount, subject to Section 482 of the BNSS and Section 438(2) of the CrPC. The order was pronounced by Justice Sandeep Kumar.
Issues considered
- Whether bail should be granted in a case involving serious offences under the Bharatiya Nyaya Sanhita.
- Whether the presence of a prior compromise petition and lack of injury report affect the bail decision.
- Whether the conditions under Section 482 BNSS and Section 438(2) CrPC are satisfied.
