The court granted anticipatory bail to petitioners 1, 2, 4, 6‑15 subject to bail‑bond conditions under Section 482, and dismissed the petition for petitioners 3 and 5 upon withdrawal.
Summary
The petitioners, a group of fifteen individuals from Damodarpur village, filed an anticipatory bail application fearing arrest in a case registered under multiple sections of the B.N.S., 2023. They alleged that the dispute arose from a petty fight resulting in injuries on both sides, and the allegations of assault were general. Counsel for the petitioners sought permission to withdraw the anticipatory bail petition for petitioners No. 3 (Ashok Ram) and No. 5 (Mahendra Ram), which the court allowed, dismissing the petition for those two. For the remaining petitioners (Nos. 1, 2, 4, 6‑15), the court examined whether anticipatory bail could be granted despite the serious nature of the offences. Relying on Section 482 of the B.N.S.S., 2023, the court ordered that they be released on bail upon furnishing a bail bond of Rs 10,000 with two sureties each. The application was consequently disposed, with bail granted to the specified petitioners subject to the stated conditions.
Issues considered
- Whether anticipatory bail can be granted under Section 482 of the B.N.S.S., 2023 for the offences alleged.
- Whether the petition for anticipatory bail may be withdrawn for specific petitioners after filing.
