Patna High Court

Hare Ram Kumar @ Hare Ram RajversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The High Court allowed the anticipatory bail application, directing release on bail with specified conditions.

Summary

The petitioner, Hare Ram Kumar, applied for anticipatory bail after being implicated in a case alleging offences under Sections 147, 148, 149, 323, 307, 379, 504 and 506 of the Indian Penal Code for an alleged assault and robbery on 20 May 2023. He contended that the allegations were false, that he has a clean antecedent, and relied on a prior order granting him liberty in a related matter. The State opposed the bail, arguing the seriousness of the offences. The Court examined the nature of the allegations, the petitioner’s claim of false implication, and the precedent of a similar anticipatory bail order. It directed that the petitioner be released on bail upon surrender within six weeks, subject to a bail bond of Rs.10,000 with two sureties, under Section 482(2) of the Criminal Procedure Code. The anticipatory bail application was therefore allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482 of the CrPC in view of the alleged offences under the IPC.
  • Whether the petitioner’s claim of false implication and clean antecedent warrants bail.
  • Whether the conditions imposed for bail are appropriate and sufficient.
