BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners with conditions under Section 482 of the B.N.S.S., 2023.

Summary

The petitioners, Ram Sakal Mahto and Manju Devi, sought anticipatory bail fearing arrest in a case registered under Sections 80 and 3(5) of the B.N.S. The prosecution alleged that the daughter of an informant, married to co‑accused Ratanlal Mahto, was subjected to dowry‑related cruelty and was murdered on 16‑02‑2025. The petitioners, being the brother‑in‑law and sister‑in‑law of the deceased, claimed they had no involvement in the family affairs or the alleged crime. The State opposed the bail application. After considering the facts, the Court ordered that the petitioners be released on anticipatory bail, subject to a bail bond of Rs.10,000 each, two sureties, and compliance with Section 482 of the B.N.S.S., 2023, if they are arrested or surrender within eight weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Sections 80 and 3(5) of the B.N.S.
  • Whether the petitioners have any material connection to the alleged dowry‑related murder warranting denial of bail
