Prince kumar RaiversusThe State of Bihar

DISPOSED

Holding

The Court granted provisional anticipatory bail to the petitioner subject to specified conditions and verification of his criminal antecedents.

Summary

Prince Kumar Rai, the petitioner, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 51.84 litres of liquor from a sack. He argued that he was not arrested on the spot, no liquor was found in his possession, and the alleged recovery occurred at a location not belonging to him, with the informant’s identity omitted from the FIR. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner surrenders within six weeks, furnishes bail bonds of Rs.10,000 with two sureties, and the trial court verifies his criminal antecedents. If more than two prior cases are found, the bail may be revoked; otherwise, it will be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 30(a) of the Bihar Excise Act.
  • Whether the conditions imposed by the Court are appropriate for granting provisional anticipatory bail.

                             2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                             3. Learned counsel for the petitioner submits that the

petitioner has antecedent of two cases out of which one case is

under the Excise Act and allegation is of recovery of 51.84 litres

                             4. Learned counsel for the petitioner submits that the

petitioner was not arrested from the spot as such nothing was

recovered from his conscious possession and even the alleged

recovery is from a place which does not belong to the petitioner

and he came to be implicated at the instance of local people, but

then the name of the person, who disclosed the name of the

petitioner is not disclosed in the FIR, which casts an aspersion

on the case of the prosecution. It is further submitted that once

an accused is implicated in a case relating to excise, the police

starts implicating mechanically either at the instance of

Chowkidar, local person, confessional statement or secret

information without holding a proper investigation.

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                   6. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the event

of his arrest or surrender before the learned trial court within a

period of six weeks from today, be released on Provisional

anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees

          Section 482(2) of the BNSS.

                   7. It is made clear that thereafter the learned Trial Court

shall verify the criminal antecedent of the petitioner and in the
