Provisional anticipatory bail is granted to the petitioner subject to bail bond, sureties, and verification of criminal antecedents as per Section 482(2) of the BNSS.

Summary

The petitioner, Virendar Mukhiya, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for allegedly recovering 14.760 litres of liquor from a motorcycle. He argued that he was not the owner of the motorcycle, nothing was seized from his possession, and the case was based solely on a confessional statement made by a co-accused in police custody, which he claimed lacked evidentiary value. The State opposed the bail. The Court granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.5,000 with two sureties and that the trial court verify his criminal antecedents within six weeks. If more than one prior case is found, the bail will not be confirmed; if only one prior case, the provisional bail will be confirmed. The order is subject to the conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the case under Section 30(a) of the Bihar Excise Act.
  • Whether the confessional statement of a co-accused can form the basis for arrest without other evidence.
  • Whether the petitioner’s criminal antecedent affects the grant of anticipatory bail.
