Decided
Disposal
BAIL GRANTED

Holding

The court held that bail be granted to the petitioner subject to a bond of Rs 10,000 and two sureties, under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Bhola @ Sunil Kumar, sought bail fearing arrest in a case registered under sections 126(2), 127(2), 352, 351(2), 3(5) of the Bharatiya Nagarik Suraksha Sanhita and section 25(1‑b)/a/35 of the Arms Act, alleging he carried a pistol and threatened an informant. He contended that the pistol was recovered from the cowshed of co‑accused Sonu Kumar and that no incriminating article was found on him, asserting his innocence. The State opposed the bail application. The High Court, after considering the facts, ordered that the petitioner be released on bail upon furnishing a bond of Rs 10,000 with two sureties of the same amount, subject to conditions under section 482(2) of the BNS. The order was directed to be complied with by the Judicial Magistrate of Nawada.

Issues considered

  • Whether bail should be granted to the petitioner under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita in view of the alleged offences.
