Patna High Court

Arse Azam AlamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to a bail bond and conditions, noting that the settlement does not preclude bail and invoking its inherent powers under Section 482 BNSS and Section 438(2) CrPC.

Summary

The petitioner, Arse Azam Alam, sought bail in a criminal case (PS Chanpatia Case No. 145 of 2025) filed under several sections of the Bharatiya Nyaya Sanhita and the Dowry Prohibition Act. He claimed that the dispute with the respondent, Reshma Khatoon, had been amicably settled and the parties intended to live together with their children. The settlement agreement was presented to the court, outlining mutual concessions and obligations. The court examined whether the settlement and the pending charges justified granting bail, invoking Section 482 of the BNSS and Section 438(2) of the CrPC. It allowed the bail application, directing release upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions and a six‑week window for arrest. The order was limited to the bail application and did not prejudice the merits of the underlying criminal case.

Issues considered

  • Whether the existence of a settlement agreement between the parties warrants the grant of bail in the pending criminal case.
  • Whether Section 482 of the Bharatiya Nyaya Sanhita and Section 438(2) of the Code of Criminal Procedure empower the court to release the petitioner on bail.
  • Whether the pending charges under the specified sections of the BNSS and the Dowry Prohibition Act preclude bail.
