BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners.

Summary

The petitioners, members of the Sahni family, sought anticipatory bail after being implicated in a case alleging the kidnapping of a minor and forced marriage to co-accused Birbal Sahni. The prosecution alleged that the petitioners entered the informant's house, abducted her daughter and married her off, violating sections of the Bharatiya Nyaya Sanhita and the POCSO Act. The petitioners contended they were innocent, asserting that the victim’s statement recorded under Section 183 of the BNSS denied any kidnapping. The court considered the victim’s statement and the petitioners’ clean antecedents, and consequently granted anticipatory bail subject to a bond and sureties, with conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The order directs that if arrested within eight weeks, the petitioners be released on bail.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners despite the serious allegations under the BNSS and POCSO Act
  • Whether the victim’s statement under Section 183 BNSS negates the prosecution’s case
