The petitioner is entitled to bail.

Summary

Dipu Kumar was arrested in connection with a kidnapping case (Paliganj P.S. Case No. 330 of 2025) under Sections 137(2), 140(3) and 3(5) of the B.N.S., 2023. The prosecution alleged that the minor daughter of an informant was abducted by Vishal Rai. The victim later gave a statement under Section 183 of the B.N.S., 2023, saying she had left home voluntarily, stayed with Vishal Rai, and subsequently met and married the petitioner of her own free will. The petitioner’s counsel argued that there was no evidence of coercion, the petitioner had no criminal antecedent and was falsely implicated. The court, after considering the victim’s statement and the lack of incriminating material, ordered that the petitioner be released on bail upon furnishing a bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail despite the kidnapping allegations under the B.N.S., 2023
  • Whether the victim’s statement under Section 183 negates the prosecution’s case
