Patna High Court

Govinda RamversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The petitioner is not entitled to bail and the bail application is rejected.

Summary

The petitioner, Govinda Ram, was arrested in connection with a murder case (Sugauli PS Case No.530/2023) alleging offences under Sections 302, 201, 120(B) and 34 of the Indian Penal Code. He claimed a clean antecedent, a long‑standing marriage, and that the informant (the victim's mother) had falsely implicated him. The State opposed bail, emphasizing that the victim was dead, the body cremated, and no post‑mortem was possible, suggesting the petitioner’s involvement. The court examined the bail application, the seriousness of the charges, and the lack of convincing evidence of innocence. Concluding that the circumstances did not warrant release, the court rejected the regular bail application.

Issues considered

  • Whether the petitioner is entitled to regular bail in a case involving murder, concealment of death and alleged conspiracy under IPC Sections 302, 201, 120(B) and 34
  • Whether the allegations and evidence presented justify denial of bail
