Patna High Court

Munna KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner.

Summary

Munna Kumar was named as an accused in a cyber‑fraud case involving multiple offences under the Bharatiya Nyaya Sanhita and the Information Technology Act. He contended that he was implicated solely on the basis of a co‑accused’s confessional statement and that no material evidence linked him to the alleged offences. The petitioner highlighted that similarly situated co‑accused had already been granted anticipatory bail in a related matter. The State opposed the bail application, arguing the seriousness and omnibus nature of the charges. Considering the lack of incriminating material against the petitioner and the principle of parity, the Court allowed the petition for anticipatory bail, directing that bail be furnished within eight weeks on a bond of Rs.10,000 with two sureties, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the nature of the accusations and the evidentiary material.
  • Whether the petitioner’s claim of innocence, based solely on a co‑accused’s confessional statement, warrants bail.
  • Whether the principle of parity with co‑accused who obtained anticipatory bail applies.
