BAIL REJECTED

Holding

The court refused to grant anticipatory bail to the petitioner.

Summary

Manjeet Kumar petitioned the Patna High Court for anticipatory bail in Criminal Miscellaneous No.83716 of 2025, fearing arrest in a case (PS No.98 of 2025) involving alleged offences under several sections of the Bharatiya Nyaya Sanhita. The allegations state that he, along with other accused, kidnapped an informant, assaulted him, stole his mobile, ATM and Aadhaar cards, withdrew Rs. 4 lakh from his bank account, took Rs. 25,000 in cash, and obtained a personal loan in the informant's name. The petitioner contended that his name does not appear in the FIR and only surfaced in the confessional statement of co‑accused Amit Kumar, asserting a clean antecedent. The court examined the seriousness of the charges and the material gathered during investigation. Considering the nature of the accusations and the evidence, the court refused the prayer for anticipatory bail.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the allegations and his absence from the FIR but presence in a co‑accused's confessional statement
  • Whether the gravity of the offences under the Bharatiya Nyaya Sanhita warrants denial of anticipatory bail
