Decided

BAIL GRANTED

Holding

The court held that anticipatory bail could be granted because the injuries were simple, the petitioners had clean antecedents, and there existed a case and counter‑case, invoking Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

Petitioners Parmeshwar Mahto and his sons were implicated in a FIR arising from a land dispute that led to an altercation with the informant's family. The FIR alleged offences under multiple sections of the Bharatiya Nyaya Sanhita, including assault and criminal intimidation. The petitioners applied for anticipatory bail, asserting that the injuries were simple, both parties had a case and counter‑case, and they possessed clean antecedents. The informant opposed the bail, but the court considered the nature of the accusations, the modest severity of injuries, and the petitioners' clean record. Consequently, the court granted anticipatory bail, directing the petitioners to surrender within eight weeks and furnish a bail bond with sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita in view of the alleged offences.
  • Whether the nature of the alleged offences and the simple injuries justify the grant of bail despite the FIR.
