Patna High Court

Manvendra Krishna BharatversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied to the petitioner.

Summary

The petitioner, Manvendra Krishna Bharat, filed an anticipatory bail application fearing arrest in a case involving multiple offences under the Bihar Narcotic Substances Act, 2023 and Section 66(E) of the Information Technology Act. The FIR alleges that he eloped with an informant, subsequently tortured and threatened her and her mother, and circulated her private photographs on social media to coerce her into withdrawing a criminal complaint and transferring property to him. The petitioner also has three prior criminal convictions. The court examined whether the seriousness of the allegations and the petitioner’s antecedents warranted the grant of anticipatory bail. Considering the nature of the accusations, the threat to the victim’s family, and the petitioner’s criminal record, the court concluded that bail could not be justified. Consequently, the anticipatory bail petition was rejected.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in view of the alleged offences under the B.N.S., 2023 and the IT Act
  • Whether the petitioner’s criminal antecedents and the nature of the allegations preclude the grant of anticipatory bail
