Holding

The Court declined to grant pre‑arrest bail.

Summary

The petitioner, Pappu Turha, sought pre‑arrest bail fearing arrest in connection with FIR No. 401 of 2025 filed under Sections 20(b)(ii)(c), 25 and 29 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The High Court examined the seriousness of the allegations under the NDPS Act and was not persuaded to grant pre‑arrest bail. The Court directed the petitioner to apply for regular bail before the District Court, which must decide the matter promptly on the same day of filing. No prejudice was to be attached to the petitioner from the High Court’s observations. Consequently, the pre‑arrest bail application was disposed of without relief.
