The court granted regular bail to the petitioner.

Summary

The petitioner, Priyanshu Kumar, was charged under sections 137(2), 96 and 3(5) of the BNS and section 8 of the POCSO Act for allegedly kidnapping the minor daughter of an informant. The petitioner sought regular bail, contending that the minor had voluntarily left her hostel with him, that she gave a statement under sections 180 and 183 of the BNSS, and that no sexual assault allegation was made. The State opposed bail, emphasizing the seriousness of the offences and the petitioner’s prior criminal antecedent. The court examined the victim’s voluntary departure, her age (15‑12‑2007, nearing 18), and the lack of sexual assault allegations, and found no justification to deny bail. Consequently, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under the POCSO Act and kidnapping provisions.
  • Whether the victim’s voluntary departure negates the element of kidnapping.
  • Whether the petitioner’s prior criminal antecedent and the seriousness of the offences preclude bail.
