Patna High Court

Mananjay YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Mananjay Yadav was arrested on 13 October 2025 in connection with a case involving alleged assault on an informant’s family and offences under several sections of the Bihar Negotiable Securities Act and Section 27 of the Arms Act. The petitioner claimed he was falsely implicated and that his brother, a co‑accused, had already been granted bail. The State opposed bail, citing the seriousness of the charges and an additional excise case pending against the petitioner. The court examined the bail petition, the nature of the offences, and the petitioner’s claim of innocence. Considering the circumstances, the court ordered the petitioner’s release on bail with a bond of Rs. 10,000 and two sureties, subject to conditions regarding cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • What is the appropriateness of granting bail to the petitioner charged with multiple serious offences under the Bihar Negotiable Securities Act and the Arms Act?
  • Does the existence of a pending excise case affect the grant of bail in the present matter?
