The bail application is allowed and the petitioner is released on bail upon furnishing the prescribed bond and sureties.
Summary
The petitioner, Rukhsar Praween, sought regular bail in a case registered under Sections 103(1), 80(2) and 3(5) of the B.N.S., 2023, alleging that she is the nanad of the deceased and has no involvement in the alleged dowry‑related murder. The prosecution alleged that the deceased was killed by her husband and co‑accused after being subjected to cruelty and harassment for dowry. The petitioner argued that she has a clean antecedent, is separate from the family property, and has been in custody since 5 September 2024. The State opposed the bail application. Considering the petitioner’s clean record, the nature of the allegations against her husband, and the period of custody, the Court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties.
Issues considered
- Whether the petitioner is entitled to regular bail under the provisions of the B.N.S., 2023 given the facts of the case
- Whether the petitioner’s relationship to the deceased (nanad) and clean antecedent justify grant of bail
